POLICY:
FLORIDA SAFETY IN PRIVATE SPACES ACT
FOR:
BBSH Students, Teachers, Graduates, Staff Members, and Visitors

Although no restrooms or changing facilities are maintained by the school, as Resident Training classes take place in a hotel and
the restrooms at the administrative office are located in a common hallway of a commercial building, the following policy has
been adapted to comply with Florida law:
In accordance with Rule 6E-7.001, FAC, and the Safety in Private Spaces Act, Florida Statute Sec. 553.865, any student, instructional
personnel, graduate, administrative staff, visitor, prospective student or prospective employee who willfully enters a restroom
designated for the opposite sex on the premises of the hotel/venue during Resident Training classes and/or at the administrative
office and refuses to depart when asked by any other administrative personnel, faculty member, security personnel, or law
enforcement personnel may result in exclusion from use of the restrooms and the facility itself, suspension or withdrawal from
school, or suspension or termination of employment.
If the individual violating the policy refuses to depart when asked by any other administrative personnel, faculty member, or
security personnel, law enforcement personnel will be called by administration to handle the violation.
The individual will be advised that she/he has been excluded from using the restrooms and the facility itself.
A report of the incident will be on record, administration and security personnel on site will complete reports and save video
footage. The incident report will become part of the student’s, faculty member’s, or administrative personnel’s permanent record.
The President of the school will determine (a) if the student serves a suspension or if the student will be withdrawal from enrollment, or (b) if the employee serves a suspension (no pay) or if the employee will be terminated from employment.
If the student or employee will serve suspension, she/he needs to be notified in person, or via email of days of suspension and
when the student is expected to return to class or the employee is expected to return to duty.
The student or employee will be given a final written warning upon return to class or to employment.
If a student or employee refuses to serve suspension, the student will be terminated from the program due to the violation of
this policy, and the employee will be terminated from employment. The student or employee will be notified of the decision in
person and via email.
If a student is terminated, the withdrawal will be processed according to the school’s Cancellation and Refund Policy (see pages
56–57).
A person may only enter a restroom or changing facility designated for the opposite sex under one or more of the following circumstances:
1. To accompany a person of the opposite sex for the purpose of assisting or chaperoning a child under the age of 12, an elderly
person as defined in s.825.101, or a person with a disability as defined in s. 760.22 or a developmental disability as defined
in s. 393.063;
2. For law enforcement or governmental regulatory purposes;
3. For the purpose of rendering emergency medical assistance or to intervene in any other emergency situation where the health
or safety of another person is at risk;
4. For custodial, maintenance, or inspection purposes, provided that the restroom is not in use; or
5. If the appropriate designated restroom is out of order or under repair and the restroom designated for the opposite sex contains no person of the opposite sex.
In the event any student, graduate, administrative or instructional personnel, or visitor believes that the institution has failed to
meet the minimum requirements for restrooms under Rule 6E-7.001, FAC, or Sections 553.865(4) and (5), F.S. she/he has the right
to file a complaint with the Attorney General. Complaints can be filed with the Attorney General’s office over the phone, by mail,
